Membership Terms And Conditions

I understand and accept the following terms and conditions-

  1. Membership Overview:

By enrolling in The Gutsy Collective Inner Circle membership, you agree to abide by the following terms and conditions. Our membership program offers access to exclusive resources, community support, and more.

Member Duties:

  • Commit to yourself to be accountable for the action items we create in our community including sessions/classes, FB group, etc.
  • Be open to new ways of learning and applying your new knowledge
  • Be open to change and allow yourself to trust in the “what if” more than fear and excuses
  • Be on time for our calls/classes
  • Be an active and supportive member of the community including attempting to make as many live sessions as possible, asking questions, sharing support needs, etc.
  • Keep our team informed of any changes to your telephone number(s), address, or email address
  • Keep up to date with fees and costs

 

Member Rules:

 

  1. Respectful Communication: Members must engage in respectful and constructive communication with fellow members and the LauraAura team. Any form of harassment, discrimination, or offensive behavior will not be tolerated.
  2. Confidentiality: Members should expect that other members may share confidential information. All Members are expected to maintain the confidentiality of any sensitive information shared within the membership program as if it were their confidential information they don’t want shared.
  3. Intellectual Property Rights: All program content and resources are protected under Copyright protection. Powerback®  is a registered trademark of Laura Wallace and LauraAuraTM is registration pending trademark of Laura Wallace. Members must respect the intellectual property rights of the program content and resources. Unauthorized sharing, copying, or distribution of course materials is strictly prohibited and subject to any and all legal rights and remedies available to LauraAura, Laura Wallace, or any other intellectual property rights owner.
  4. Active Participation: Members are encouraged to actively participate in discussions, group activities, and events within the membership program to foster a supportive community environment.
  5. Payment Obligations: Members must fulfill their payment obligations promptly according to their chosen payment plan (monthly or annual). Failure to do so may result in suspension or termination from the membership program.
  6. Compliance with Terms & Conditions: All members are required to comply with the terms and conditions outlined by the membership program regarding access rights, cancellation policies, and payment information.
  7. Feedback & Suggestions: Members are encouraged to provide feedback and suggestions for improving the membership experience but should do so constructively and respectfully.
  8. Non-Solicitation Policy: Engaging in direct solicitation or promotion of personal products/services within the membership community without prior authorization is not allowed unless explicitly permitted by LauraAura in advance.
  9. Termination/Suspension Rights: LauraAura and team reserve the right to terminate or suspend a member’s participation in case of violation of these member rules or any other behavior deemed detrimental to the integrity of the community as determined at their discretion.

 

  1. Payment Plans: 

a) Monthly Payment Plan: Members who choose the monthly payment plan are required to commit to a minimum of six (6) consecutive months. The initial payment will be made at the time of sign up and members will be automatically charged every 30 days thereafter. Following the minimum 6-month membership requirement, your membership will continue on a month-to-month basis until you choose to cancel.

 

b) Annual Payment Plan: Members who choose the annual payment plan are required to commit to twelve (12) consecutive months. The initial payment will be made at the time of sign up and members will be automatically charged every 12 months thereafter unless the member chooses to cancel. 

 

c) Any chargeback or disputes with your bank or credit card issuer may result in legal action against you for the value of your commitment under the payment plan. If LauraAura must initiate legal action to collect fees, you will also be required to pay all reasonable legal fees and costs associated with any legal action to obtain fees owed to LauraAura. 

 

  1. Powerback® Course:

 

   As part of the membership benefits, members will have access to the Powerback® course. The course materials will be made available through the online membership platform during the duration of their active period.

 

  The access granted for the Course is for personal use only. It is understood that members may not share their login credentials or provide unauthorized access to others.

 

3a. Non-Disclosure:

   All information shared within the Powerback® course is confidential and proprietary to LauraAura™, including but not limited to course content, strategies, techniques, methodologies, and any other proprietary information disclosed during the duration of the course.

 

3b. Prohibited Actions:

   It is strictly prohibited to copy or record any part of the Course materials through screenshots, screen recordings, or any other means without prior written consent from LauraAura™.

 

 Additionally,

a) Members may not share or distribute any part of the Course materials with third parties.

b) Members may not sell or resell access to the Course.

c) Members may not use any part of the Content for commercial purposes without explicit prior permission granted in writing by Laura Wallace.

    

3c. Copyright Infringement:

   Any unauthorized use or distribution of copyrighted material from our On-Demand Digital Course will be considered copyright infringement and subject to legal action under applicable laws. LauraAura™, Laura Wallace, and any other intellectual property owner do NOT disclaim any right or remedy available under the law. Violations of intellectual property rights will be prosecuted to the fullest extent of the law.

 

  1. Auto-Renewal:

 

   Unless otherwise specified or canceled by the member prior to their renewal date, memberships will automatically renew for subsequent periods based on your chosen payment plan (monthly or annually). Members can cancel their membership by reaching out to us at admin@worxand.co prior to the renewal date.

 

  1. Refunds:

We do not offer refunds, prorated pricing, or reimbursements for any payments made toward membership programs.

 

  1. Termination/Cancellation Policy:

   We reserve the right to terminate any member’s participation in our program if they violate these terms and conditions or engage in any behavior deemed inappropriate or harmful to other members.

 

Should a member choose to cancel their membership following the minimum duration period listed below, it is understood that they must email admin@worxand.co to notify of the termination in writing and allow a minimum of 14 days to process their request. The membership will then continue through the last day of the current billing cycle. 

 

  • Monthly Membership: Minimum 6-month commitment 
  • Yearly Membership: Minimum 12-month commitment

 

If a member wishes to cancel their membership prior to fulfilling the minimum duration period, it is understood that:

 

  • Monthly memberships will be required to continue making payments until they’ve satisfied the 6-month minimum membership requirement and will have access to the materials and resources through the end of the final billing cycle.

 

  • Yearly memberships will not receive reimbursement when choosing not to fulfill the entire year membership but will continue to have access to the material and resources through the end of the current billing cycle.

 

  1. Modifications:

   LauraAura™ reserves the right to modify these terms and conditions at any time. Any changes will be communicated to members via email and through our website.

 

  1. Limitation of Liability:

   LauraAura™, Laura Wallace, and its employees, officers, owners, or agents shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from your participation in the membership program. . If a dispute arises, the Member’s sole legal remedy will be limited to the total amount of Membership fees paid in the calendar year preceding the claim.

 

Each Member acknowledges and agrees that they are assuming the risk of interacting with other Members and that  LauraAura™, Laura Wallace, and its employees, officers, owners, or agents cannot control, nor is responsible for, the actions of other Customers. Member agrees to indemnify, defend, and hold harmless the  LauraAura™, Laura Wallace, and its employees, officers, owners, or agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with the Member’s interactions with other Members.

 

  1. Governing Law:

 These terms and conditions shall be governed by and construed in accordance with the laws of Pennsylvania. Any disputes arising out of or related to these terms and conditions shall be conducted in the state or federal courts located within Pennsylvania. Each Member is consenting to the personal jurisdiction of state and federal courts in Pennsylvania.

 

  1. Miscellaneous Matters

While we may very well discuss very personal subjects, you acknowledge that Laura Wallace, LauraAuraTM, or any other team member is not a therapist, psychologist, licensed clinical social worker, psychiatrist, or other medical or mental health professional. No one at LauraAura can diagnose, treat, or cure any mental or physical health condition and Coaching is not the proper forum for those types of efforts. IF YOU FEEL YOU NEED MEDICAL OR MENTAL HEALTH SERVICES, YOU SHOULD SPEAK TO A QUALIFIED MEDICAL OR MENTAL HEALTH PROVIDER.

Laura Wallace, LauraAura™, or any other team member are not a lawyer, accountant, or financial advisor. While we may talk about these subjects related to your business, Coaching is not a substitute for these kinds of expert advisors. If you need these kinds of services, we may be able to help you find a qualified service provider, but the responsibility for seeking proper advice is yours alone.
